Can I refuse a breathalyzer test?




 

 

As of May 1, 2024, you can no longer request the 15-minute waiting period.

Indeed, modern devices are perfectly capable of detecting and taking into account alcohol in the mouth without this 15-minute waiting time being respected.

However, you cannot refuse the test. You would automatically be considered "positive" if necessary.

Test Results

S (safe)

The alcohol content is below the maximum value allowed by law (<0.22 mg/litre EAA or 0.5 g/litre of blood) - EAA: exhaled alveolar air

A (alarm)

The result is positive, i.e. the alcohol content is greater than or equal to 0.22 mg/litre EAA but less than 0.35 mg/litre EAA (0.8 g/l of blood).

Your licence will be held for three hours by the Police.

P (positive)

The result is positive, i.e. the alcohol content is greater than or equal to 0.35 mg/liter EAA.

  1. between 0.35 mg/litre and 0.65 mg/litre, your licence is held for six hours by the Police.
  2. above 0.65 mg/litre, it is decided to proceed with an immediate withdrawal of the driving licence (minimum of 15 days) confirmed by the King Prosecutor.
